Please read carefully before engaging in custom design services provided by Elegant Damage Atelier. This agreement outlines the terms under which we create custom home décor and artistic pieces based on your ideas, preferences, and submitted information.
 
     Services, Design & Communication
 
• Custom pieces are created based on the specifications, photos, preferences, and information provided in the official custom-order form. The completed form is the primary source of information used to create your piece.
• Conversations via phone, email, social media, or other platforms before or after submission of the form are not considered part of the official order unless specifically confirmed in writing by Elegant Damage Atelier.
• Any changes or additions after submission of the custom-order form must be made in writing. Changes are strongly discouraged once design or production has begun and may incur a $40 or 10% non-refundable design change fee, whichever is greater.
• Custom pieces are handmade works of art. Exact replicas of photos, inspiration images, or preexisting designs are not guaranteed. Materials, components, colors, or other elements may be substituted due to availability, sourcing, or artistic considerations.
• Elegant Damage Atelier maintains creative discretion over the final composition, arrangement, and execution of each piece while considering the requested design direction.
• Timely communication is required. Delays in receiving information, approvals, payments, or responses may affect the project timeline.
 
     Payment
 
• A non-refundable $75 deposit is required to begin the custom-order process. Payment confirms the client’s commitment and reserves time and resources for the project.
• An additional 25% payment may be required before design work begins when a piece involves specialty materials, unusual items, custom-sourced components, or significant upfront expenses.
• The remaining balance is due within 3 days of order completion. A 5% daily late fee applies to unpaid balances.
• Rush orders requested within 2 weeks of the requested completion date incur a $40 rush fee, if the project can be accommodated.
 
      Cancellation
 
• Custom orders cannot be cancelled by the client once the $75 deposit has been paid. The deposit is non-refundable.
• If the client chooses not to proceed after submitting the deposit, the project will be discontinued and the $75 deposit will be retained.
• If an additional payment has been made for specialty materials or custom-sourced items, those funds may be retained to cover materials or items purchased specifically for the project.
• Elegant Damage Atelier reserves the right to decline or cancel a custom order at any time, for any reason. If Elegant Damage Atelier cancels an order, any amount paid toward the order that has not already been used for the project will be refunded, excluding the non-refundable $75 deposit.
• No refunds are offered for completed custom orders.
 
     Pricing & Shipping
 
• Pricing includes materials, labor, and design services unless otherwise stated.
• Shipping costs are the client’s responsibility and are paid through the provided payment or shipping link.
• The client may have the option to purchase shipping insurance. Insurance is the client’s responsibility and is intended to provide coverage for eligible loss or damage occurring during transit.
• Elegant Damage Atelier is not responsible for shipping delays caused by late payments, carrier delays or mishandling, weather, or circumstances outside of our control.
 
     Care & Display
 
• Elegant Damage Atelier pieces are intended for display in a climate-controlled or otherwise protected indoor environment. Prolonged exposure to extreme heat, direct sunlight, humidity, moisture, rain, or other harsh environmental conditions may cause fading, deterioration, discoloration, warping, or damage to materials.
• Outdoor display is not recommended unless the piece has been specifically designed and approved for outdoor use. Elegant Damage Atelier is not responsible for deterioration or damage resulting from improper display, storage, or environmental exposure.
• Keep all Elegant Damage Atelier pieces away from open flames, candles, fireplaces, heat sources, and other ignition sources. Our pieces may contain materials that can burn, melt, scorch, or otherwise become damaged when exposed to heat or flame. Elegant Damage Atelier is not responsible for damage resulting from exposure to flame or excessive heat.
For the love of all things dead, DO NOT put a candle next to, on, or into the piece.
 
     Liability
 
• Elegant Damage Atelier is not responsible for delays, loss, or damage once a completed order has been transferred to the shipper, client, or designated recipient.
• If there is a concern regarding a completed piece, it will be reviewed on a case-by-case basis. Refunds are not offered; however, a replacement or other resolution may be provided at the discretion of Elegant Damage Atelier.
• The client is responsible for promptly reviewing and responding to requested design approvals, questions, or other communications. Failure to respond may affect the project timeline.
• Handmade pieces may contain minor variations in materials, placement, texture, color, and overall appearance. These variations are inherent to handmade artwork and are not considered defects.
 
     Governing Law
 
• These Terms & Conditions are governed by the laws of the State of Arizona. Any legal action arising from these services shall be subject to the jurisdiction of the courts located in Pinal County, Arizona.
• By submitting a custom-order request and engaging the services of Elegant Damage Atelier, the client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
• Questions regarding these Terms & Conditions may be directed to Elegant Damage Atelier.
• Elegant Damage Atelier reserves the right to amend these Terms & Conditions at any time.
